Rules of subscription to the service

• 1.1 Subscription to the service includes access to the closed sections of the Site and/or the ability to read, use and other features determined by the Administration, and is provided to Visitors at any time for a fee in the following order:

• 1.1.1 Acquisition of the right to use the Subscription is allowed after passing the registration / authorization procedure of the Visitor on the Site. The right to use the Subscription is granted to the Visitor in full from the moment of the beginning of granting the Visitor access to the use of additional functionality of the Website according to clause 1.1. of these Rules.

• 1.1.2 The price and the period of granting the right to use the Subscription are indicated at: https://krak.ai/subscriptions. The cost of granting the Subscription includes 20% VAT.

• 1.1.3 For the purposes of these Rules, the period of granting the right to use the Subscription is understood to be the period of time (e.g. a month) for which the Visitor is granted the right to use the Subscription and the corresponding fee is set.

  • The access period of two weeks starts to run from the date of payment for the Subscription and expires after 14 calendar days.

  • The access period equal to one month starts on the date of payment for the Subscription and expires on the corresponding day of the calendar month following the date of payment.

  • An access period of three months begins on the date of payment for the Subscription and expires on the corresponding day of the third calendar month following the date of payment.

  • An access period of six months begins on the date of payment for the Subscription and expires on the corresponding date of the sixth calendar month following the date of payment.

  • If the end of the period calculated in months falls in a month in which there is no corresponding number, the period expires on the last day of that month.

  • The Visitor accepts the terms and conditions of the Subscription by paying an advance payment in the amount of 100% of the cost of the services provided.

• 1.1.4 The Subscription fee is paid by the Visitor by bank transfer from a bank card (Visa, MasterCard, Maestro and MIR) via the YUKassa service, as well as via cryptocurrencies Bitcoin, Etherium, Litecoin and Tether (USDT) to the address specified in the payment window.

  • When paying with the help of the UKаѕѕа service, after confirming the selected option of the access period a secure window with the payment page of the UKаѕѕа processing center will open, where it is necessary to enter the holder's bank card data. For additional authentication of the cardholder 3D Secure protocol is used. If the cardholder's bank supports this technology, the cardholder will be redirected to its server for additional identification. Information on the rules and methods of additional identification should be clarified with the bank that issued the bank card.

  • The processing center of UKassa protects and processes the data of the holder's bank card according to PCI DSS 3.2 security standard. Information is transferred to the payment gateway using SSL encryption technology. Further transfer of information takes place via closed banking networks with the highest level of reliability. SKSA does not transfer the bank card data of the holder to the Administration and other third parties. 3D Secure protocol is used for additional authentication of the cardholder.

• 1.1.5. The Administration has no access to the data of the bank card specified by the Visitor, except for the data received from YUKASSA and necessary for displaying information in the Account: type of bank card, validity period of the bank card, country of the bank card issuing bank, the first 6 (BIN) and last 4 digits of the number of the bank card, and is not responsible for the safety and confidentiality of the transferred data when making non-cash payment.

• 1.1.6 In cases stipulated by the current legislation, cashier's checks on transactions are sent to the Visitor to the e-mail address specified when registering in the Account or when making a payment via the YUKASSA service.

• 1.1.7. The Visitor is obliged to keep the documents confirming the payment of the right to use the Subscription during the entire period of use of the Website, and at the request of the Administration to provide such documents, as well as information about the circumstances of the relevant payment.

• 1.1.8 When choosing a monthly period of access to the Subscription, the Visitor has the right to choose the option of automatic extension of the access period for the next period equal to one month

• 1.1.9 The Administration shall debit the funds in the form of an advance payment in the amount of 100% of the cost of one month of the services provided for the next month of Subscription no later than 1 (one) day before the end of the current month of the access period. The date of the next debit is indicated in the Visitor's Account.

• 1.1.10. When paying for the first period of the Subscription via the UKassa service, the Visitor provides bank card details (bank card number, expiration date of the bank card, CVV/CVC security code) and authorizes the Administration to charge the Subscription fee (subscription fee) set for the day of payment from the linked bank card account until the Visitor refuses to extend the Subscription for the next period.

  • The debiting of funds in accordance with this clause of the Rules shall start to take place on an automatic basis under the following conditions:

    • selecting the option of automatic extension of Subscription access;

    • the Visitor enters all the necessary details for linking the card to make a payment via the UKassa service;

    • pressing the "Pay" button (or any other button similar in functionality), confirming the Visitor's agreement with these Terms and Conditions of Subscription provision.

• 1.1.11. The Visitor understands and agrees that the Subscription by default is issued indefinitely from the moment of payment of the first Subscription period, and may be terminated at any time by the Visitor's refusal in the manner provided in paragraph 1.1.12. of these Rules, or on other grounds provided for in these Rules (change of price, violation of the rules).

• 1.1.12. The Visitor may cancel the Subscription at any time by clicking on the "Unsubscribe" button in the Account.

  • Cancellation of the Subscription by the Visitor, as well as:

    • lack of funds on the account of the bank card linked by the Visitor when paying for the Subscription, on the day of debiting the funds for payment for the next Subscription period;d

    • eletion by the Visitor of the data of the bank card linked by the Visitor when paying for the Subscription from the Account;- is the cancellation of the Subscription by the Visitor;

    • in this case the Subscription of the Visitor is terminated from the day following the last day of the paid period.

• 1.1.13. The Visitor may at any time refuse to continue using the Subscription; in such case the Visitor shall send a notice of such refusal to the Administration, the Visitor's access to the Subscription shall be terminated from the moment the Administration receives the notice. The refund to the Visitor shall be made in accordance with the procedure 1.4.1.1.1. of these Rules.

• 1.1.14. The Visitor is obliged to independently monitor information about the status of the Subscription (paid Access Period, cost, list of available functionality), as well as to monitor changes and amendments to these Rules.

• 1.2 The Administration has the right to unilaterally, at any time and without prior notice to the Visitor to change the terms of granting the right to use the basic and additional functionality of the Site, including the cost and terms of granting the right to use the Subscription. In this case, the cost of the already paid right to use the Subscription may not be changed.The changes shall come into effect from the date of making the respective changes and publishing the notice of changes on the Website at https://krak.ai/subscriptions.In case of changes in the Subscription price, the Subscription shall be terminated from the date of entry into force of the relevant changes in the service price and the funds shall not be debited from the Visitor's bank card for the next Subscription period. In this case, the Visitor's access to the Subscription shall be terminated from the day following the last day of the paid period.

• 1.3 The Visitor guarantees to the Administration that he has the right to freely dispose of the funds chosen by him to pay for the rights to use the Subscription, without violating the laws of the Russian Federation and / or the laws of another country of which the Visitor is a citizen, and the rights of third parties. The Administration is not responsible for possible damage to third parties caused as a result of the use of funds not belonging to the Visitor.The Visitor understands and agrees that all actions made through his Account, including cashless payment using a bank card, are considered to be made by the Visitor.Underage Visitors may not use paid services without the consent of their legal representatives.

• 1.4. The Website Administration has the right to suspend without notice at any time and without giving any reasons for the period at the discretion of the Administration and/or terminate the Visitor's access to the Website, its basic and/or additional functionality, as well as the ability to use the services unilaterally out of court without reimbursement of any costs, losses, payment of any fines and penalties.

• 1.4.1 In case of suspension and/or termination of the ability to use the Subscription unilaterally out of court, the Administration within 5 working days from the date of the relevant changes shall notify the Visitor of its actions by sending a message to the e-mail address provided during registration on the Site and shall have the right to choose:

• 1.4.1.1 Refund to the Visitor the funds paid by the latter for the right to use the Subscription, pro rata for the period of time (or other unit of measurement of additional functionality) during which the Visitor will not be able to use the additional functionality of the Site.The Visitor from the date of receipt of the notice of suspension and/or termination of the ability to use the Subscription is obliged to send to the Administration at: kraken.genius77@gmail.com a notice of readiness to accept funds with the indication of payment details for the acceptance of funds. The notice shall be deemed proper if it contains all the information necessary to make the payment. Within 5 working days from the date of receipt of the notice of readiness to accept funds, the Administration shall transfer funds to the details specified by the Visitor in the notice;

• 1.4.1.2. provide the Visitor with the opportunity to exercise the right to use the Subscription during the remaining paid period of time (or other unit of measurement of additional functionality) after the expiration of the period of access suspension set by the Administration.

• 1.5. The Administration of the Website has the right to suspend the Visitor's access to the Website, its basic and/or additional functionality, as well as the ability to use the services, without notice at any time and without explanation, in case of any violation by the Visitor of the terms of these Rules and/or separate agreements for the provision of information services, as well as in case the Administration considers the actions of the Visitor fraudulent or aimed at damaging the Website, undermining the reputation of the Website or brand, the organization of the organization of the Subscription service, and in case the Administration considers the Visitor's actions to be fraudulent. In this case, the funds paid by the Visitor are not refundable, and the Visitor's Account is blocked permanently or for a period of time established at the discretion of the Administration.

• 1.6 In case of disputable, unclear situations, or sending to the Visitor any offers of third parties related to payment for the right to use the main and additional functionality of the Site, as well as services offered on the Site, or placement of such ads and offers on the Internet, the Visitor shall immediately notify the Administration of the Site. If the Visitor, having violated this provision, has made payment under the specified announcement using the details specified in such announcement, the Visitor's claims to the Administration about his/her lack of access to any of the functionality of the Site shall not be accepted, and the Administration shall not compensate the Visitor for the money spent by him/her under such circumstances.

• 1.7 Users recognize and agree that the Administration does not provide the User with communication services, which are regulated by the Federal Law "On Communications" of the Russian Federation, and is not responsible for malfunctions on the equipment and communication networks owned by third parties and used to provide communication services to the User.
